About this policy
NurseCare Connect (“we”, “us”) provides NDIS, disability, nursing and aged care supports across Queensland. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and as a registered NDIS provider we also follow the NDIS Code of Conduct and NDIS Practice Standards on information management.
This policy explains how we handle personal information, including the health and disability information that the law treats as sensitive information and protects more strictly.
What we collect
What we collect depends on how you deal with us.
People we support, and referrals
- Name, date of birth, address, phone and email
- NDIS number, plan details and plan management type, or Home Care Package details
- Health, disability, medication and support needs, and information from treating health professionals
- Contact details for family, guardians, nominees, support coordinators and plan managers
- Records of the supports we provide, including care notes and incident reports
Job applicants and staff
- Contact details, resume, cover letter, qualifications and work history
- Screening information such as NDIS Worker Screening and Working with Children checks, where the role requires them
Everyone else
- Your name and contact details when you enquire, send feedback or make a complaint. You can give feedback anonymously.
- Name, delivery address and contact details when you order from our shop. Card payments are handled by our payment provider, and we never see or store your full card number.
How we collect it
We collect information directly from you wherever we can: through the forms on this website, by phone, email or in person. Sometimes we receive it from someone else, such as a support coordinator, plan manager, family member, guardian, GP or hospital making a referral. When that happens we will let you know, and we only use it to arrange or provide your supports.
If you make a referral on someone else’s behalf, please make sure they know, and agree, that you are sharing their information with us.
How we use it
- To respond to enquiries and referrals, and to assess whether we can meet someone’s needs
- To plan, deliver, roster and review safe, quality supports
- To claim and invoice through the NDIA, plan managers, Home Care Package providers or you
- To recruit, screen and manage our workforce
- To handle feedback, complaints and incidents, and to improve our services
- To process and deliver shop orders
- To meet our legal, reporting and audit obligations
We only collect sensitive information with your consent, or where the law requires or allows it, for example to lessen a serious threat to someone’s life, health or safety. We do not sell personal information, and we do not use it for third-party marketing.
Who we share it with
We only share what is needed, and only for the purposes above. This can include:
- The NDIA, your plan manager, support coordinator or Home Care Package provider
- Your nominees, guardians or family, where you have agreed or they are legally authorised
- Your GP, hospital and other health professionals involved in your care
- The NDIS Quality and Safeguards Commission and other regulators, where the law requires it, such as reportable incidents
- Service providers who work for us, such as our rostering and care-records system, IT hosting, email and payment providers. They may only use the information to provide their service to us.
- Police, courts or government agencies, where the law requires it
Overseas storage
We store our records in Australia wherever we can. Some of the technology providers we use, for example for website hosting, email and payments, are based overseas, mainly in the United States, and may process information there. We take reasonable steps to make sure they protect it in line with the Australian Privacy Principles.
Security and retention
We protect personal information with access controls, staff logins, encryption in transit, and staff training and confidentiality obligations. Staff only see the information they need to do their job.
We keep records of the supports we provide for at least seven years, as NDIS rules require, and longer where another law requires it. After that we destroy or de-identify them securely. Unsuccessful job applications are kept for a shorter period unless you ask us to keep your details on file.
If a data breach is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.
Access and correction
You can ask to see the personal information we hold about you and ask us to correct it if it is wrong, out of date or incomplete. Contact our Privacy Officer using the details below. We will respond within 30 days. There is no charge to make a request. If we cannot give you access, for example where it would unreasonably affect someone else’s privacy, we will explain why in writing.
